The sole assignment of error is the refusal of the court to grant defendants' motions for nonsuit.

Ernest Patterson died as a result of injuries suffered in a collision between an Oldsmobile, which he was driving, and a Cadillac driven by defendant Hewitt. Defendant Rash owned, and was riding in, the Cadillac at the time. The collision occurred shortly after midnight on 14 March 1964 in Rutherford...
