On May 24, 1965, there was filed in the Akron Municipal Court a paper designated "Finding" but which was, in effect, conclusions of fact and conclusions of law. Included in this "finding" was a judgment dismissing an affidavit theretofore filed against one Harry I. Meltzer. Previous to the filing of this "finding," a docket notation was made on March 30, 1965, which is as follows:

"The defendant having entered a plea of Not Guilty to the charges...
