RIVES, Circuit Judge:

Juelich is serving a life sentence for the murder of a Deputy United States Marshal in an escape from custody. Upon his first trial he was sentenced to death. This Court reversed. Juelich v. United States, 5 Cir. 1954, 214 F.2d 954. Juelich was thereafter granted a change of venue from the Northern District of Georgia to the Southern District of Alabama. Upon re-trial, he was again convicted, but his punishment was fixed at life imprisonment...
