OPINION BY WRIGHT, J., March 18, 1965:

On the evening of April 3, 1959, Shelton C. Sharpe was operating a Yellow Cab in a southerly direction on Broad Street in the City of Philadelphia. He stopped for a red traffic light at the intersection of South Street. While the cab was in a stationary position, it was struck in the rear by a motor vehicle operated by John Steel.
