HOLMES, Justice.

This is a Workmen's Compensation case in which the Trial Judge found that the petitioner's injury did not arise out of his employment and dismissed the petition for compensation. The employee's motion for a new trial was overruled and he has duly perfected his appeal to this Court.

In his memorandum opinion, the Trial Judge stated:

"Now, gentlemen, in this case petitioner was walking up some steps when he fell because his leg failed...
