The plaintiff and one of the defendants herein, Harry A. Simon & Sons, hereinafter referred to as Simon, each seeks to be entitled to the full amount of the proceeds derived from the sale of certain furniture and furnishings and similar personal property which was located in the Anthony Wayne Hotel at Hamilton, Ohio. The plaintiff claims to be entitled to such proceeds by virtue of a chattel mortgage which had been placed upon said personal property...
