Defendant, James Carlock Babb, was tried to a jury, convicted and sentenced to a term of five years' imprisonment under a single count indictment charging him with receiving and concealing a stolen 1962 model Oldsmobile, which was moving in interstate commerce, knowing that said vehicle had been stolen.
