On September 13, 1961, the plaintiff, Rosa Stewart, took a truck owned by herself and her husband onto the grounds of defendant Manor Baking Company's plant, located at 4050 Penn Avenue in Kansas City, Missouri. At this plant the company offered for sale stale bread which was widely used as feed for livestock. The Stewarts operated a farm and fed livestock.
