Defendant was indicted for the crime of larceny in the nighttime in that he did steal, take and carry away from a private building soybeans exceeding $20 in value, in violation of section 709.4, Code, 1962. He pleaded not guilty, was tried before court and jury, found guilty and sentenced to an indeterminate term not exceeding ten (10) years in the penitentiary at Fort Madison and to pay the costs. Defendant's appeal was submitted upon a clerk's transcript...
