Defendant was charged by county attorney's information with the crime of operating a motor vehicle while intoxicated on March 11, 1965, and that this was a second offense, in violation of section 321.281 Code, 1962. He pleaded not guilty, was tried before court and jury, found guilty of the crime of operating a motor vehicle on March 11, 1965. He was not found guilty of the charge of second offense.
