On October 3, 1965 the defendant, Austin Strauss, set up a table, 4 feet by 4 feet, on the sidewalk close to the curb 30 feet south of the corner of Sixth Avenue and Eighth Street in Greenwich Village. The table contained literature opposing American foreign policy in Viet Nam and condemned our armed intervention there. An American flag was attached to the table. The defendant had planned to speak on his opposition to our Viet Nam action...
