Defendant was charged by county attorney's information with the crime of rape by having carnal knowledge of a female under the age of 17, defendant being over the age of 25, in violation of section 698.1, Code, 1962. He pleaded not guilty, was tried before court and jury, found guilty, and sentenced to the State Penitentiary at Fort Madison for a term of 25 years and ordered to pay the costs of the action.
