PER CURIAM.

Under an indictment charging defendant with the crime of assault with intent to murder in violation of section 690.6, Code, 1962, defendant pleaded not guilty. Upon trial to court and jury he was found guilty of the included offense of assault and battery in violation of Code section 694.1. He was fined $100 and costs and in default of payment of the fine was ordered confined to the county jail one day for each $5 of the fine remaining unpaid. Defendant...
