The Augusta Fire Department Credit Union, a Georgia corporation, filed a suit in the Superior Court of Richmond County against Daniel E. Mulcay, Jr. on January 29, 1963. Its petition as amended alleges in substance: The defendant was its secretary and treasurer from 1937 until his removal on January 12, 1963.
