Defendant, Benny Niles, was charged by information with burglary in violation of Penal Code section 459, and with assault by means of force likely to produce great bodily injury in violation of Penal Code section 245. Two prior felony convictions were alleged, to wit: manslaughter in Louisiana in 1941, and assault with a deadly weapon in California in 1951.
