WATSON v. STATE

No. 3749.

165 So.2d 801 (1964)

Hubert WATSON, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida. Second District.

June 26, 1964.

Attorney(s) appearing for the Case

Walter R. Talley, Public Defender, Bradenton, for appellant.

James W. Kynes, Atty. Gen., Tallahassee; Robert R. Crittenden, Asst. Atty. Gen., Lakeland, for appellee.

PER CURIAM.

The Attorney General has suggested error in this cause. The record before us fails to affirmatively show that the appellant was represented by counsel at the time of his arraignment and sentence or that he intelligently and understandably waived his right to the assistance of counsel.

The judgment appealed is accordingly reversed.
