When this action came on to be heard in the general county court, the parties, pursuant to the provisions of G.S. § 1-184 et seq., waived trial by jury. On defendant's appeal to the superior court, Judge McLean overruled all of defendant's assignments of error and affirmed the judgment of the general county court.
