Julia Hankins was arrested by a South Dakota Highway patrolman and charged with having committed the crime of drunken driving on an Indian Reservation on August 4, 1962 in violation of the statutes of South Dakota. On process duly issued by a Justice of the Peace she was imprisoned. The same day she petitioned the circuit court for a writ of habeas corpus which was issued. Pending a hearing thereon she was admitted to bail and released on her own recognizance...
