SNEAD, Justice.

As a consequence of his conviction of operating a motor vehicle under the influence of intoxicants Claude R. Rowland, the defendant, appealed the judgment to this court.

The defendant pleaded not guilty to the offense and a jury trial was waived. At the conclusion of the city's evidence, defendant's motion to strike the evidence was overruled. At the conclusion of all the evidence defendant was found guilty as charged in the warrant. His punishment...
