MARSHALL, Circuit Judge:

Julie R. Blitz, plaintiff in these two suits, appeals from judgments of dismissal under Rule 12(b) (6) in both. The orders were entered simultaneously on June 15, 1963. The government moved to consolidate the actions below, but the motion was rendered moot by virtue of the court's decision. Since the cases were argued together, we dispose of them in one opinion.
