Mr. Justice McINTYRE delivered the opinion of the court.

Dorothy Parker, plaintiff, sustained injuries from an incinerator in a school cafeteria at which she worked, in Cody, Wyoming. She sought damages from several defendants including Heasler Plumbing & Heating Company, a partnership, which had installed the incinerator. Summary judgment was granted for Heasler, and an appeal therefrom is now before us.
