This is an appeal from the circuit judge's denial of plaintiff's motion for new trial. Plaintiff had instituted suit against defendant Smolbrook in the Wayne circuit court for injuries arising out of an automobile collision, which suit was settled by entry of a consent judgment in plaintiff's favor on August 10, 1962.
