This is a civil action for actual and exemplary damages brought under the Texas Wrongful Death Statutes, Vernon's Ann.Tex.St. arts. 4671 et seq., and art. 16, § 26 of the Texas Constitution Vernon's Ann.St.

Austin Chevis, a longshoreman employed by James J. Flanagan Shipping Corporation, was accidentally killed at Beaumont, Texas, while working aboard the Steamship LENA LUCKENBACH. Owner of the vessel was Luckenbach Overseas Corporation...
