This action involves a wholesale and retail ice cream operation in Helena, Montana. For several years prior to February 1, 1955, Edward F. Hagler and Theodore E. Olson were partners in the "Dairyland Dairy Store." The partnership was dissolved by written agreement executed on February 1, 1955, with Hagler taking the retail business and Olson taking the wholesale business.
