This is a declaratory judgment suit attempting to fix ultimate liability for the satisfaction of certain tort claims. Real parties in interest on the appeal are the appellant, Bryan Brothers Packing Company (hereinafter called Bryan), and the appellee American Fidelity and Casualty Insurance Company (hereinafter called American).
