Appellant,1 a Wayne County, West Virginia, Constable, and candidate for reelection in the November 6, 1962, General Election, using an illegal and allegedly fictitious warrant issued by his wife, a Justice of the Peace, while accompanied by another officer, arrested Homer Fraley at approximately 3:30 A.M. election morning, and placed him in jail.
