POWERS, Justice.
This proceeding in equity was brought by the administrator d.b.n.c.t.a. of the estate of Ellen N. Tillinghast, praying for construction of the will of said testatrix and for instructions thereunder in accordance with the provisions of G.L. 1956, § 9-24-28. When the cause was ready for hearing for final decree in the superior court, it was duly certified to this court for our determination.
