This is an action in redhibition wherein plaintiff, Jefferson K. Aiken, Sr., seeks rescission of the sale of a 1961 Plymouth automobile purchased from defendant, Moran Motor Company, Inc., on August 30, 1961. In essence plaintiff contends the vehicle, admittedly a demonstrator, represented as having low mileage, was in effect a new car and was sold and expressly warranted as a new automobile.
