This action was instituted by the Secretary of Labor who seeks to recover wages on behalf of Otis Washington, an employee of defendants who operate the Dixie Fish and Oyster Company in Columbia, South Carolina. This action was brought under the provisions of Section 16(c) of the Fair Labor Standards Act of 1938, as amended (hereinafter referred to as the "Act"), 29 U.S.C. § 216(c).
