The petitioner, William F. Hamrick, was indicted by the Grand Jury in Mercer County, West Virginia, July 5, 1963, for unarmed robbery. Counsel was appointed to represent him by the Judge of the Circuit Court of Mercer County. After some "bargaining" between the appointed counsel and the Prosecuting Attorney, the latter said that he would recommend the "minimum sentence of 5 years" upon a plea of guilty.
