JOSLIN, Justice.
This action of assumpsit was brought to recover an amount allegedly owing by the defendant to the plaintiff on the purchase price of an automobile. The defendant denied liability and also claimed damages because of an alleged breach of warranty. The case was tried before a justice of the superior court sitting without a jury and resulted in a decision for the plaintiff in the amount of $500 and costs.
