The Court derives its jurisdiction in this action from the provisions of 28 U.S.C. § 1346(a) (1).

The suit is for the recovery of Federal Estate taxes paid on the estate of John F. Boyle, Jr., or, in the alternative, for a refund of Federal Income taxes for the years 1955 through 1958, paid by Joseph Keane and Hudson County National Bank as Executors of the Estate of Regina T. Boyle...
