This was an appeal from the Probate Court by agreement of the parties on an agreed statement of facts under the provisions of R.S. Ch. 153, Sec. 32, as amended.

Charles Otis Foss died testate on March 3, 1963 survived by his widow but leaving neither issue nor kindred. The widow and testator were living together at his decease. His entire estate consists of personal property. His will made certain specific bequests including some provision...
