Thomas L. Jenkins sustained injuries to his person and damage to his automobile when it and one owned by Melvin Bierschenk collided on a public highway west of Cedar Rapids, Iowa, in the late afternoon of August 27, 1960. Jenkins brought this diversity action against Bierschenk and his wife who, with permission, was driving the car at the time of the accident. The case was tried to the court without a jury.
