The complaint alleges that E. H. Lyster, the plaintiff, was in one of the B. F. Goodrich Tire stores in Mobile, Alabama, to purchase tires when Earl Jones, branch manager of the store, in the scope and furtherance of his employment, attacked Lyster without provocation, causing serious injury.
