This Court previously denied an interlocutory injunction. Upon appeal the denial of the interlocutory injunction was affirmed and the case remanded for prompt determination on the merits. Pettaway v. County School Board of Surry County, No. 9286, 332 F.2d 457 (4th Cir. 1964).
