The appellant, Eddie Lee Gaskin, was indicted by the Grand Jury of Baldwin County for the offense of grand larceny in the felonious taking and carrying away from a storehouse one Motorola transistor radio, valued at $22.95, belonging to Gordon McLemore. After a trial by jury in the Baldwin County Circuit Court, the appellant was found guilty as charged and sentenced by the court to a term of three years in the penitentiary.
