Lyles, the appellant here, as a result of information received from an accomplice, was indicted by the grand jury of Ector County, Texas in February of 1961 for the crime of burglary. A warrant was then issued for his arrest. Upon waiving extradition, he was returned to Ector County from California and placed in the Odessa City jail at 12:05 A.M.
