On May 28, 1964 there was filed in this Court a petition in error, with casemade attached, attempting to appeal from an order of the district court of Pottawatomie County, Oklahoma fixing the date for the execution of the death sentence heretofore returned against the plaintiff in error (hereinafter referred to as the defendant).
