Plaintiffs instituted this action in magistrate court by filing a statement alleging that defendants had breached a contract entered into by the parties and that by reason thereof plaintiffs were entitled to liquidated damages. Defendants defaulted and judgment was entered against them in the sum of $2000.00. Defendants appealed to the circuit court and the cause was tried to that court, de novo, without a jury.
