SCOTT, Judge:

Respondent determined deficiencies in petitioner's income tax for the calendar years 1958, 1959, and 1960 in the respective amount of $285.89, $159.15, and $375.08.

The issues for decision are:

(1) Whether petitioner is entitled to a deduction in the calendar year 1958 for a loss occasioned by the destruction of a driveway servicing property which he owned and had rented to various tenants...
