FORD, J.

The defendant was found guilty by a jury of the crimes of forgery (Pen. Code, § 470) and grand theft (Pen. Code, § 487, subd. 1) in a second trial, a jury having been unable to reach a verdict as to either charge in the first trial. He has appealed from the ensuing judgment and from the order denying his motion for a new trial.

The case of the prosecution was that the defendant had signed the names of his uncle and aunt to a promissory note...
