JACKSON, Justice.

In the trial court, Alpha Finance Company filed a petition asking for the foreclosure of a $74,000 note and mortgage against substantial oil and gas leaseholds owned by a defendant Great Western Oil and Gas Company. Shortly after suit was filed, and before any defendant had answered, R.J. Roberts was substituted as party plaintiff upon motion by Alpha, which motion was heard and sustained without notice...
