This is an application made pursuant to CPLR 5704 (subd. [a]) to vacate an order to show cause, granted ex parte, requiring all persons interested in a corporation to show cause before a Referee, designated in the order, why the corporation should not be dissolved. The order to show cause is predicated upon a petition under section 1104 of the Business Corporation Law.
