ROBERTS, Justice.

This petition for a writ of habeas corpus was brought by the petitioner to obtain his discharge from the allegedlly unlawful custody of the respondent administrator of the department of probation. The peitioner has been in the custody of the respondent pursuant to an order of a justice of the family court issued on February 7, 1963 placing him on probation for a period of one year after having been adjudged in contempt of that court.
