This suit was brought by the State of Texas, acting through the Texas Water Commission, formerly the State Board of Water Engineers, and Rudolph Hoefs, against James T. Slaughter and others to enjoin defendants from diverting water from Barilla Creek in Pecos County. Slaughter claimed that he held vested appropriative rights in the waters of Barilla Creek which he acquired under the Irrigation Act of 1895 (Texas General Laws 1895, Chap. 21, p. 751...
