DIETERICH, J.

The writ of error raises several issues. The first issue is whether the trial court erred in not granting plaintiff in error's motion to dismiss on the ground that he was denied a speedy trial.

Sec. 7, art. of the Wisconsin constitution, provides in part as follows:

"In all criminal prosecutions the accused shall enjoy the right to be heard by himself and counsel; to demand the nature and cause...
