This is a motion by plaintiff for summary judgment.

An insurance policy was issued to deceased Anna M. Corder in the amount of $5,000 on April 27, 1960. The beneficiaries listed in said policy were Wesley D. Corder, husband of the insured, if living, otherwise Willa Eakman, mother of the insured. On April 15, 1963 the named insured died.
