Relator was convicted of robbery in the first degree after a trial in the Erie County Court in February 1937, and was sentenced to a term of 40 to 75 years on February 23, 1937 after admitting prior felonies. His petition alleges that his federally-protected right to a fair trial was violated by the prosecution's suppression of evidence material to his defense.
