PER CURIAM.

Defendant was charged by information with the offense of failure to have his motor vehicle under control, while driving upon the public highway, in violation of section 321.288(3), Code, 1962, I.C.A. His demurrer to the information was overruled, he pleaded not guilty, was found guilty and ordered to pay a fine of $50 and costs. In default of payment of the fine defendant was ordered committed to the county jail one day for each $31/3 of the fine, as authorized...
